  • Stop any activity causing pain or concern.

  • Any blood tests required as part of the plan selected are not a substitute for professional medical care. Share the results with your doctor.

  • All content is owned by Shape Your Energy and cannot be copied or used commercially without permission.

  • With your written consent, we may use photos (e.g., before-and-after) for marketing purposes.

  • The Contract starts once you accept the Terms and make full payment.
  • The contract ends when the Plan period concludes (e.g., a 30-day Plan ends after 30 days). 
  • Multi-month or ongoing packages continue for the paid duration.
  • Use of our services is at your own risk.

  • Shape Your Energy is not liable for injuries, losses, or outcomes resulting from non-compliance or misuse.

  • Contact us first if you have any concerns. We will respond within 14 days.

  • You retain the right to pursue legal action if necessary.

By purchasing a plan or consultation, you agree that Shape Your Energy can start the service immediately. Because the services are personalized and delivered digitally, your right to withdraw ends once the plan or session has started or been delivered.

Full Terms and Conditions 

These Terms & Conditions (“Terms”) govern your use of the Shape Your Energy website and services. Shape Your Energy is operated by PICINCU ANDRA-EDVIGIA PFA (“I,” “we,” “us,” or “our”). By accessing this website or purchasing any services, you agree to these Terms.

1. Introduction

1.1 Who we are: Shape Your Energy is a business registered as PICINCU ANDRA-EDVIGIA PFA in Galati, Romania.

1.2 Contacting us: You may contact us at andra@shapeyourenergy.com. 

1.3 Our communications: We may contact you by email, SMS, WhatsApp, or telephone using the details you provide.

1.4 Writing: “Writing” includes emails, SMS, or online messages (e.g., WhatsApp). When these Terms refer to “writing” or “written,” this includes these formats.

1.5 Relationship: Nothing in these Terms creates a relationship of employment, agency, or partnership between the parties.

1.6 Third-party rights: These Terms are between you and Shape Your Energy. No other person has rights to enforce them.

1.7 Governing law: These Terms are governed by the laws of Romania, without regard to conflict of law principles.

1.8 Severability: If any provision is found invalid, void, or unenforceable, it will be replaced with a valid provision reflecting the original intent. The remainder of the Terms remains in effect. If your country’s law provides higher consumer protection standards, those take precedence.

2. Services Provided

2.1 Shape Your Energy offers personalized health and fitness services, including but not limited to:

  • Custom workout plans
  • Custom nutrition and diet plans
  • Educational health, fitness, and nutrition content
  • Consultations and coaching services

All services are delivered digitally or remotely unless otherwise agreed in writing.

2.2 Assessment & Eligibility: Before purchasing a Plan, you may be asked to complete a short assessment form and participate in a follow-up call to confirm eligibility. The assessment may cover:

  • Allergies or food intolerances
  • Fitness level
  • Existing health conditions
  • Other relevant information

2.3 Allergies & Substitutions: If you notify us of an allergy or intolerance, guidance will be provided to replace or remove ingredients. You are responsible for your own dietary and health choices.

2.4 Recommended Products: Any supplements or products we recommend are separate agreements between you and the provider. We make no guarantees regarding these products (see Clause 13 – Affiliate Partners).

2.5 Physical Training: Training programs are personalized based on your information. Each program outlines exercise selection, duration, repetitions, and sets. Guidance may be provided in writing or via video links. Any suggested resistance or weight is indicative only; you are responsible for adjusting loads based on your abilities.

2.6 Delivery Timelines: Estimated timelines for Plans are provided individually. These are estimates and not guarantees. Once delivered, a Plan is considered complete.

3. Eligibility

3.1 By using our services, you confirm that you:

  • Are recognized as an adult under applicable law
  • Are legally capable of entering a binding agreement
  • Will provide accurate and complete information

3.2 We may refuse to provide a Plan for medical reasons. Our Plans are not suitable for individuals with severe illnesses, injuries, organ diseases, eating disorders, pregnant women, or anyone under 18.

4. Nature of Services & Disclaimer

4.1 Our services are for educational and informational purposes only and do not constitute medical advice. Always consult a qualified healthcare professional before starting any new exercise or nutrition program.

4.2 If a blood test is part of your Plan, it is not a substitute for professional medical care. Results should not be relied upon to diagnose or treat any medical condition.

4.3 You are responsible for sharing any blood test results with your healthcare provider.

4.4 By using our services, you acknowledge and accept all associated risks.

5. Client Responsibilities

You agree to:

  • Provide accurate, honest, and complete personal and health information
  • Follow guidance responsibly
  • Stop any activity that causes pain or discomfort
  • Seek medical advice when appropriate

We are not responsible for outcomes resulting from incomplete, inaccurate, or withheld information.

6. Payments & Pricing

6.1 All prices are displayed on the website or communicated prior to purchase. Full payment is required before delivery of any Plan or service.

6.2 Accepted payment methods are shown at checkout. All payments are processed through secure third-party providers. Shape Your Energy does not store payment details.

6.3 First-time or additional consultations require payment in advance. Consultation fees are non-refundable unless otherwise agreed.

6.4 Booking a consultation does not obligate you to purchase a Plan.

6.5 We are not responsible for bank fees, exchange rates, or declined payments. Failed payments may delay or cancel your service, and we reserve the right to recover reasonable costs or damages.

7. Refunds & Cancellations

7.1 Custom Plans are non-refundable once delivered or started. Refunds may only be considered if work has not yet begun.

7.2 For live sessions or consultations, cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may result in forfeited fees.

7.3. Right of Withdrawal –Exceptions. Under applicable consumer protection laws, EU consumers may lose their right of withdrawal in certain situations.

In particular, the right of withdrawal does not apply where:

  • A service has been fully delivered, and you expressly requested that it begin immediately, acknowledging that you would lose your right of withdrawal once the service was completed.
    This includes personalized services such as consultations, custom nutrition plans, or training programs once they have been created or delivered.

  • Digital content is provided, and access or delivery begins after you have expressly agreed to the immediate performance of the service and confirmed that you understand you will lose your right of withdrawal.
    This applies to digital plans, guides, programs, documents, videos, or other downloadable or online materials supplied by Shape Your Energy.

Because Shape Your Energy services are personalized and delivered digitally, once performance has begun or the service has been completed, refunds or withdrawals are no longer available, unless otherwise required by law.

7.4. By agreeing to these Terms & Conditions, you expressly consent to the immediate provision of personalized digital services by Shape Your Energy and acknowledge that, due to the customized nature of the services, your right of withdrawal will be lost once performance has begun or the plan has been delivered.

8. Intellectual Property

All content, materials, and communications from Shape Your Energy are our property and protected by intellectual property laws. You may not:

  • Copy, share, resell, or redistribute content
  • Claim ownership of content
  • Use content commercially without written permission

9. User-Submitted Content & Media

9.1 We keep your private information secure and confidential (see Privacy Policy).

9.2 With your express written consent, we may publish, display, or share photos (e.g., before-and-after) publicly, including commercial use. Personally identifiable information will be removed upon request.

9.3 By submitting content, you confirm you have the rights to share it and are not infringing any laws or third-party rights.

10. Contract Duration

10.1 The contract begins when you accept these Terms and complete payment for the selected Plan or service.

10.2 The contract ends at the conclusion of the Plan period. Multi-month or ongoing packages continue for the paid duration. Extensions require separate agreements and payment.

10.3 Delays caused by missing, incomplete, or inaccurate information from you may result in adjusted timelines or fees.

10.4 A Plan is considered complete once its duration ends, unless follow-ups or additional sessions are agreed in writing.

11. Limitation of Liability

Shape Your Energy is not liable for:

  • Injuries, losses, or damages from participation in services
  • Indirect, incidental, or consequential damages
  • Outcomes related to misuse or non-compliance

Your use of services is at your own risk.

12. Indemnification

You agree to indemnify and hold harmless Shape Your Energy from claims, losses, or expenses arising from:

  • Your use of services
  • Violation of these Terms
  • Providing false or misleading information

13. Changes to Terms

13.1 We may update these Terms at any time. Updates take effect from the date communicated.

13.2 Continued use of services indicates acceptance. If you do not agree, you must stop using the services.

14. Affiliate Partners

Our website may contain affiliate links. We only recommend brands we use or trust. Commissions help support our work.
